1. Acceptance of Terms

By electronically accepting “Terms and Conditions” at registration you also accept and acknowledge this Liability Waiver, and agree that you are the custodial parent or legal guardian (the “Legal Representative”) of the minor child being registered (the “Participant”), or have authority to act on (the “Participant”) behalf as a Non-Legal Guardian, in the CrankCourage cycling program described in your registration (the “Program”). Registration and payment confirm your acceptance of these Terms and all related policies, including the CrankCourage Liability Waiver and Privacy Policy. You acknowledge and agree, for yourself and on behalf of the Participant (together, the “Releasors”), as follows:

2. Program Participation

CrankCourage programs are designed to teach safe cycling skills in a structured, supportive environment. Participants are expected to meet the minimum age and skill requirements listed for each program.

All participants must wear properly fitted helmets and appropriate clothing for the duration of the program. Parents and guardians are responsible for ensuring their child’s bike and gear are in safe working condition before class.

For the safety and enjoyment of all riders, CrankCourage reserves the right to remove any participant from a program if behavior or noncompliance compromises safety or disrupts instruction. Refunds will not be issued in these circumstances.

3. Payment and Refund Policy

Full payment is required at the time of registration to secure a spot in the selected program.

Program registration closes 3 days prior to class start. No refunds will be issued within 7 days of the program start date. If a participant withdraws after the program has begun, no refund or credit will be provided. Transfers are available following the 3 day registration guideline. Example: If registering 5 days before program start, refunds will not be issued. However, you may still transfer to another available class, within the 3 day registration guideline.

4. Class Changes, Cancellations, and Weather Policy

CrankCourage reserves the right to modify class times, dates, or locations due to weather, low enrollment, or unforeseen circumstances.

In the event of a class cancellation a make-up session or credit may be offered based on availability. Refunds are not guaranteed for weather-related cancellations.

5. Assumption of Risk and Liability Waiver

Participation in cycling activities involves inherent risks, including but not limited to falls, collisions, and environmental factors. By enrolling in a CrankCourage program, you acknowledge and accept these risks on behalf of the Participant.

By accepting the Terms and Conditions at registration, you are also agreeing to the CrankCourage Liability Waiver, which outlines the release of liability and assumption of risk for all participants.

6. Medical Consent

In the event of injury or medical emergency, you authorize CrankCourage staff to provide basic first aid and to seek emergency medical assistance if necessary. Parents or guardians will be contacted as soon as possible.

7. Media and Photography

During programs, CrankCourage staff may take photos or videos for training, promotional, or educational purposes. By registering, you grant permission for the Participant’s image to be used in CrankCourage materials. CrankCourage is not held liable for your personal content shared on social media, please post responsibly.

8. Privacy Policy

CrankCourage collects and stores personal information only for registration, communication, and safety purposes. Personal data is never sold or shared with outside parties. For full details, please refer to our Privacy Policy.

9. Indemnity and Limitation of Liability

You agree to hold harmless and indemnify CrankCourage, its owners, instructors, and affiliates from any claims, damages, or losses arising from participation in our programs.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising under these Terms will be resolved within the jurisdiction of Colorado courts.
